These Terms of Use (“Terms”) govern your use of growthwright.co (the “Site”), operated by Growthwright LLC, a Colorado limited liability company (“Growthwright,” “we”). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
Client services are covered by separate agreements
The Site describes our services. It is not an offer or a contract for services. Any project, retainer or other engagement with Growthwright is governed by a separate written agreement, such as a master services agreement and statement of work. If those agreements conflict with these Terms, the written agreement controls.
Use of the Site
You may use the Site for lawful purposes, including learning about Growthwright and contacting us. You agree not to:
- use the Site in a way that violates any law or the rights of others;
- attempt to gain unauthorized access to the Site, its servers or any connected systems;
- interfere with or disrupt the Site, including by introducing malware or overloading it with requests; or
- misrepresent your identity or affiliation when contacting us or booking a call.
Search engines, AI tools and quoting
We want the Site to be found and cited. Search engines and AI assistants may crawl and index the Site as permitted by our robots.txt file. You and they may quote and summarize short portions of the Site’s content, provided the source is credited as Growthwright with a link to the relevant page. This does not grant permission to republish whole pages or present our content as your own.
Intellectual property
The Site and its content, including text, graphics, the Growthwright name and logo, and the Site’s design, are owned by Growthwright or its licensors and are protected by intellectual property laws. Except as stated in these Terms, you may not copy, modify, distribute or create derivative works from the Site’s content without our written permission.
If you send us ideas or feedback about the Site or our services, we may use them without any obligation to you.
Information on the Site
Content on the Site, including answer pages, articles and examples, is provided for general information only. It is not professional, legal or financial advice for your specific situation. Results described on the Site depend on the circumstances of each engagement and are not a guarantee of future results.
Scheduling and third-party services
You may book calls with us through Cal.com and reach other third-party services from links on the Site. Those services are governed by their own terms and privacy policies, and we are not responsible for their content or practices.
Disclaimer of warranties
The Site is provided “as is” and “as available.” To the fullest extent permitted by law, Growthwright disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Site will be uninterrupted, error-free or free of harmful components.
Limitation of liability
To the fullest extent permitted by law, Growthwright and its members, employees and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or related to your use of the Site. Our total liability for any claim arising out of or related to the Site will not exceed one hundred U.S. dollars (US$100). These limits apply to your use of the Site only; liability for client services is governed by the applicable written agreement.
Indemnification
You agree to defend, indemnify and hold harmless Growthwright from claims, losses and expenses, including reasonable attorneys’ fees, arising out of your misuse of the Site or your violation of these Terms.
Governing law and venue
These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws rules. Any dispute arising out of or related to these Terms or the Site will be brought exclusively in the state or federal courts located in Colorado, and you consent to their jurisdiction.
Changes to these Terms
We may update these Terms from time to time. When we do, we will change the “Last updated” date above. Your continued use of the Site after changes take effect means you accept the updated Terms.
General
If any part of these Terms is found unenforceable, the rest will remain in effect. Our failure to enforce any provision is not a waiver. These Terms are the entire agreement between you and Growthwright regarding the Site.
